Introduction — Both

This policy applies to the Continuum Dataguard Technologies website and to the PELAV™ app. It explains what personal information may be collected, how it is used, and the choices available to you.

Information collected through this website — Website

This website does not use a contact form. It displays a direct email address and WhatsApp number so you can contact Continuum yourself. Any information you choose to send us this way — such as your name, email address and the content of your message — is only collected if you choose to send it. Browsing the website itself does not require an account.

Information collected through the PELAV™ app — PELAV™ App

Using the PELAV™ app requires an account. The app collects the following categories of information:

Account information

Your email address and password when you create an account. Your password is handled by our authentication provider and stored using industry-standard security practices; Continuum does not have access to your password in readable form.

Location and GPS data

When you use a location-based feature (such as viewing nearby fishing spots, or checking marine and weather conditions for your area), PELAV™ will ask for permission to access your device's location while the app is in use. PELAV™ does not access your location in the background or when the app is closed. Your coordinates are used to request weather, marine and tide information for that location, as described further under "Cloud services and third-party services" below. Your precise coordinates are not saved as part of your catch or fishing session records — those records store a location description rather than raw GPS coordinates.

PELAV™'s Maps feature displays map imagery using OpenStreetMap. When the map is shown, your device requests map tiles directly from OpenStreetMap's servers based on the area of the map currently in view. When the map is centred on your own position, this reveals your approximate location, at a resolution determined by the map's zoom level, to OpenStreetMap; your device's IP address is also visible to OpenStreetMap's servers as part of these requests. OpenStreetMap does not receive your PELAV™ account information and has no means of linking these tile requests to your identity.

Catch and fishing session records

When you log a catch or a fishing session, PELAV™ stores the information you enter — such as species, date and time, a location description, weight and length (where provided), bait, hook, trace and notes — together with, where available, a snapshot of weather and marine conditions (such as wind, swell, tide and moon phase) recorded automatically at that time to help you review conditions later.

Digital Fishing Licence Vault

If you choose to use the Digital Fishing Licence Vault, PELAV™ stores a copy of your licence document together with details such as your name, licence number, issuing authority and validity dates, entirely on your own device. This information is not uploaded to Supabase or any other Continuum server, and Continuum cannot access it.

Account status

Your account record includes a status indicating whether you have Free or Premium access. Premium pricing and features are still being finalised and are not yet available for purchase through the app.

How information is used — Both

Information submitted through the website's contact form is used solely to respond to your enquiry. Information collected through the PELAV™ app is used to provide your account and the features you use — including storing your catch and fishing session records for your own reference, providing weather, marine and tide information, maintaining your Free/Premium account status, and diagnosing and fixing technical problems. We do not use this information for advertising, or for any purpose unrelated to providing and supporting the website or the app.

Contact enquiries — Website

When you submit the contact form, the details you provide are used to understand and respond to your enquiry. We do not share the contents of your enquiry other than as necessary to respond to it or as required by law.

Cloud services and third-party services — PELAV™ App

PELAV™'s account, catch, fishing session and account-status data is stored using Supabase, our backend and database provider. This project's Supabase infrastructure is hosted in the eu-west-1 (Ireland) region.

To provide weather and marine condition information, PELAV™ sends your device's coordinates directly to Open-Meteo, a third-party weather data provider, when you request that information for your location. To provide tide information, PELAV™ sends an approximate, rounded version of your coordinates (to approximately 1.1 km precision) to our own backend, which requests tide data from WorldTides on your behalf — WorldTides does not receive your exact location directly from your device. Our backend temporarily caches the rounded coordinates and the resulting tide data for up to approximately 12 hours to avoid repeated requests; this cache is not linked to your account.

PELAV™ uses Firebase Crashlytics, a Google service, to help us identify and fix technical problems. If the published app encounters an error, technical diagnostic information (such as device type, operating system version, and details about the error) may be sent to Firebase. This only applies to the published app, not to development or testing builds.

Website and technical information — Website

As with most websites, our hosting infrastructure may automatically process standard technical information — such as IP address, browser type and access times — as part of normal website operation. This information is not used to personally identify visitors.

Cookies and similar technologies — Both

This website does not currently use cookies or similar tracking technologies. The PELAV™ app does not use advertising or analytics tracking technologies. If this changes in future, this policy will be updated accordingly.

Disclosure of information — Both

We do not sell or trade personal information. Information is disclosed only to the service providers described above (necessary to operate the website and the app), or where disclosure is required by law.

Data security — Both

We take reasonable measures to protect personal information against loss, misuse and unauthorised access, appropriate to the nature of the information involved. Your catch and fishing session records are stored in a way that restricts access to your own account — other PELAV™ users cannot view your records.

Data retention — Both

Personal information submitted through the website's contact form is retained only for as long as is reasonably necessary to respond to your enquiry, after which it may be securely deleted.

There is currently no fixed automatic retention period for PELAV™ app account, catch or fishing-session data. This data is kept until you delete an individual record, or until you delete your account as described below.

Account and data deletion — PELAV™ App

You can delete an individual catch record at any time from within the app. You can also permanently delete your entire PELAV™ account from the app's Profile screen. Account deletion is immediate once confirmed and cannot be undone. Deleting your account removes your catch records, your fishing session records, your account status information, and your authentication/account data.

The Digital Fishing Licence Vault is stored only on your own device and is not uploaded to Supabase, so it is not removed by server-side account deletion. If you want to remove that information as well, you can delete it directly within the app, or by uninstalling the app from your device.

Your rights under South African law — Both

South Africa's Protection of Personal Information Act (POPIA) gives individuals rights in relation to their personal information, including the right to request access to, correction of, or deletion of personal information held about them, and the right to lodge a complaint with the Information Regulator. Requests relating to personal information collected through the website or the PELAV™ app can be directed to Continuum using the contact details below.

International data location — PELAV™ App

The infrastructure Continuum uses to operate the PELAV™ app, including Supabase and Firebase, may store and process information outside South Africa. Using the website or the app may therefore involve your information being processed internationally.

Children's privacy — Both

The website and the PELAV™ app are not directed at children, and we do not knowingly collect personal information from children.
