PELAV
Version 2.0 · Last updated 14 October 2026
PELAV ("the App") is provided by Continuum Dataguard Technologies ("we", "us", "our"). This Privacy Policy explains what personal information PELAV processes, why, who else receives it, how long it is kept, and the choices and rights you have.
Responsible party: Continuum Dataguard Technologies. Registration number: 2026/247252/07. Physical address: Durban, KwaZulu-Natal, South Africa.
Information Officer: Pranesh Ramkhelawan, enzo@continuumdataguardtech.co.za.
Contact: admin@continuumdataguardtech.co.za.
PELAV is only for people aged 18 or older. You must confirm that you are 18 or older when you create an account, and again whenever you accept updated Terms and this Privacy Policy. We do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has an account, contact us and we will delete it.
When you create an account we collect your email address and a password. The password is handled by our authentication provider (Supabase Auth) and stored only in hashed form; we never see it in plain text. We use your email address to run your account, to send account emails (confirming your email address and resetting your password), and to contact you about your account where necessary. You need an email address and a password to create an account; without them you cannot use the App.
Our authentication service also keeps an audit log of account events (for example sign-up, sign-in, sign-out, session refresh and account deletion). Each entry records the event, its time, your account identifier and your email address, and can record an IP address.
When you accept the Terms and Conditions and this Privacy Policy, our server records the versions you accepted, the date and time, your confirmation that you are 18 or older, and whether you accepted at sign-up or later in the App. We keep these records to show what you agreed to. Records from before version 2.0 that were filled in automatically by an earlier version of our system are labelled as such and are not treated as your acceptance of version 2.0.
With your permission, PELAV uses your device's precise location while you are using the App. PELAV does not track your location in the background. You can refuse or withdraw location permission in your device settings; Home and Marine still work with reduced features.
Your location is used as follows:
Your device's coordinates are not stored in your account, your catch history or your fishing sessions. When you are signed in, our backend knows which account asks for conditions at the time of the request (to apply the refresh limits in 3.6), but it does not record the location or grid area against your account.
When you log a catch, we store what you enter: species, location, weight, length, bait, hook, trace, notes, and date and time. The location of a catch is a place name you choose from PELAV's fishing-spot directory or type yourself, not GPS coordinates. Your catch record has a photo field, but this version of the App does not let you attach photos.
When you start a fishing session we store a session identifier, start time, location label (a place name, or the words "Current Location"), target species, and, where available, a snapshot of weather, sea and tide conditions taken at the start of the session. When the session ends we store the end time and status (active, ended or abandoned). A session does not track your location while it is open. If about 12 hours pass we may ask whether you are still fishing; if about 72 hours pass without you returning, the session is marked abandoned. An abandoned session is not presented as a no-catch result.
This information is linked to your account so that you can see your history. Database rules allow only your account to read or change it through the App.
This version of the App is free. It has no Premium tier, does not sell subscriptions and does not offer free trials; every feature is available to every account. When it starts, the App still asks our server for your account's access status. Our server's access records can hold a free trial (start and end time), a paid subscription (a hashed reference to the purchase, the product, its state and expiry), complimentary access (its reason, who granted it, and when it starts and ends) and, for accounts created with earlier versions of the App, whether the account had Premium in those versions. This version of the App does not create trial or subscription records. These records are linked to your account and are deleted with it.
To keep the service available for everyone, our server counts how often your account asks for fresh conditions within a short time window. Each count covers one hour. How long counts are kept is set out in section 7.
PELAV uses Firebase Crashlytics (Google) to find and fix crashes. When the App crashes, Crashlytics receives a crash report containing technical information such as the stack trace, device model, operating-system version and app version, together with Crashlytics and Firebase installation identifiers. PELAV does not attach your email address or account identifier to crash reports. How long Google keeps crash reports is set out in section 7.
Some information never leaves your device:
PELAV tells Android not to include any of this in device backups or device-to-device transfers. If you lose or reset your device, any Licence Vault document stored on it is gone. Your account data is held on our servers and returns when you sign in.
If you use Recommend a Friend, your device's own share sheet sends a short text that you choose where to send. PELAV does not see who you share it with.
Section 3.3 describes the current version of the App. Versions 1.3.0 and older work differently for current conditions on the Home and Marine screens: if you still use one of those versions, your device sends its coordinates directly to Open-Meteo's free service, without passing through PELAV's backend. Open-Meteo does not receive your PELAV account details. Updating to the current version ends this. Tides and maps work as described in 3.3 in those versions too.
We process personal information only where section 11(1) of the Protection of Personal Information Act 4 of 2013 (POPIA) allows it, and only as much as each purpose needs:
To provide the App you signed up for (section 11(1)(b), performance of our agreement with you, which is our Terms and Conditions):
You choose whether PELAV may use your location through your device's location permission, and you can turn it off at any time; some features are then limited.
Our legitimate interests (section 11(1)(f)):
Each record is limited to what that purpose needs and is kept only for the period in section 7. You can object to this processing on reasonable grounds relating to your particular situation (section 9).
Obligations imposed by law (section 11(1)(c)):
We do not rely on your consent for any of this processing, and we do not use your personal information for direct marketing.
We use these service providers. Each processes information only as needed to provide its service to PELAV, under its own terms and privacy practices.
We do not sell your personal information, and we do not share it for advertising.
All of these providers are outside South Africa:
The level of protection differs by country:
We transfer personal information to these providers because the transfer is necessary to perform our agreement with you, that is to provide, maintain and fix the App you use (section 72(1)(c) of POPIA). Each provider receives only the information listed in section 5.
You can delete your account at any time in the App: Profile > Delete Account. You can also do this from the screen that asks you to accept updated terms, without accepting them. Deletion:
Information that deletion does not remove is listed in section 7: authentication audit-log entries, crash reports already sent, provider logs, and disaster-recovery backups until they are replaced.
The on-device cleanup happens after the server deletion succeeds and depends on the App being able to run it; if it does not complete, uninstalling the App removes it.
If you cannot use the App, email admin@continuumdataguardtech.co.za from the email address of your PELAV account and ask us to delete it. We will verify the request and process it as soon as reasonably possible. Full details are on our account deletion page.
Under POPIA you have the right:
If you object, we stop that processing unless the law provides for it. If we can no longer protect or run your account without it, you can delete the account. You can turn off location permission at any time in your device settings.
To exercise these rights, contact us at admin@continuumdataguardtech.co.za. We may ask you to confirm your identity first, normally by writing from your account's email address.
You also have the right to complain to the Information Regulator of South Africa:
We use encrypted connections, access controls in our database that keep each account's records separate, and server-side handling of provider credentials. Our own backups are encrypted. No system is completely secure, and we cannot guarantee absolute security. If there are reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorised person, we will notify the Information Regulator and you, as section 22 of POPIA requires. We will do so as soon as reasonably possible after we discover the compromise, taking into account the legitimate needs of law enforcement and the steps needed to determine its scope and restore the integrity of our systems. We will delay telling you only if a public body responsible for investigating offences, or the Information Regulator, decides that notifying you would impede a criminal investigation. We will tell you in writing, normally by email to your account's email address, with enough information for you to protect yourself: the possible consequences, what we have done or will do about it, what we recommend you do and, if known, who accessed or acquired the information. We cannot notify you if we cannot establish your identity.
When we change this policy we publish a new version with a new version number and date. When the Terms or this Privacy Policy change, the App asks you to read and accept the new versions before you continue; you can instead sign out or delete your account. We do not treat continued use as acceptance.
