PELAV

Terms and Conditions

Version 2.0 · Last updated 14 October 2026

PELAV ("the App") is provided by Continuum Dataguard Technologies ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of the App. Read them together with our Privacy Policy and our Safety and Disclaimers notice.

Please read before you accept. Section 7 explains the risks of relying on PELAV's information, section 18 limits our liability, and section 20 asks you to compensate us for claims caused by your breach of these Terms or your unlawful use of the App. None of them removes a right that the law gives you and that cannot be excluded (section 19).

1. Acceptance

You accept these Terms by ticking the acceptance box when you create an account, or on the screen the App shows when these Terms change. Your acceptance, the version you accepted and the time are recorded by our server. If you do not accept, do not use the App; you can sign out or delete your account from that screen.

2. Eligibility

You must be 18 or older to create an account or use PELAV, and you confirm this when you accept these Terms. You are responsible for keeping your login details secure and for activity under your account. Tell us at admin@continuumdataguardtech.co.za if you suspect unauthorised access.

3. What PELAV provides

PELAV is an informational fishing-companion app for the South African coast. It provides a personal catch and fishing-session log, a map of fishing spots, weather, sea, tide and moon/solunar information, species information and recommendations, best-fishing-window suggestions and a PELAV Readiness Score. This version of the App has no Premium tier (section 10). Section 7 explains important limits on all of this information.

4. Your catch and session records

You own the catch and session records you enter ("Catch Data"). PELAV stores them, linked to your account, to show you your history and, where available, the conditions recorded when a session started. Database rules allow only your account to read or change your records through the App. PELAV has no public feed or public profile, and does not make your Catch Data public.

A fishing session does not track your location while it is open. If about 12 hours pass we may ask whether you are still fishing; if about 72 hours pass without you returning, the session is marked abandoned. An abandoned session is not treated as a no-catch result.

5. Your responsibilities

You agree to give accurate information, to use PELAV only lawfully and for your own personal purposes, and to comply with all fishing laws and regulations that apply to you (section 8).

6. Location, maps and third-party data

With your permission, PELAV uses your device's location to show nearby fishing spots and to fetch weather, sea and tide information for your area. You can refuse or withdraw location permission at any time in your device settings; some features will then be limited. The Privacy Policy explains exactly where your location is sent.

The fishing-spot markers are a curated directory maintained by PELAV; they are not based on your location history and are not a statement that a spot is safe, open, legal or suitable. Map tiles and weather, sea and tide data come from third parties (section 14) and may be inaccurate, out of date or unavailable.

7. Weather, tide, readiness and recommendation information

Read this before you fish. PELAV's weather, sea, swell, wind, tide, moon/solunar, forecast, species-recommendation, best-fishing-window, Readiness Score and map information is for general planning only. It comes from third-party providers and automated calculations and can be wrong, late, incomplete or unavailable.

This information is not a guarantee of your safety or anyone else's, of marine or navigation safety, of the accuracy of any weather, tide, swell or wind value, of fishing success or fish being present, or of the suitability of any location. It is not emergency information. Tide predictions must not be used for navigation or any purpose where people, property or the environment could be harmed.

The Readiness Score, outlook, best-fishing windows and species recommendations are automated, general guidance based on a limited set of environmental factors. They are not a safety assessment and do not replace your own judgement.

You alone decide whether and where it is safe to fish. Before you go, check official sources such as the South African Weather Service, the National Sea Rescue Institute, your local harbour authority or lifeguards. PELAV does not replace official warnings, marine-safety information, emergency services or local authorities, and must not be relied on in an emergency.

8. Fishing licences, regulations and species information

You are responsible for holding any licence or permit the law requires and for complying with all regulations, including bag and size limits, closed seasons, protected species and marine protected areas.

PELAV's species information, including any closed-season or protected-species information and the App's choice not to recommend a species during a closed season, is general information that may be incomplete or out of date. It is not legal advice and does not tell you what is lawful. Always check the current official regulations.

9. Digital Fishing Licence Vault

The Digital Fishing Licence Vault is not available in this version of the App. You cannot add, replace, view or delete a licence document in the App.

If you stored a licence document with an earlier version of the App, it stays in the App's private storage on that device, kept separately for each PELAV account signed in on that device. PELAV does not upload it or have access to it, and it is not included in Android backups or device transfers. You can remove it from the device by deleting your PELAV account in the App (section 16), by clearing the App's data in your device settings, or uninstalling the App. Clearing the App's data or uninstalling the App also removes the other information the App keeps on that device (see the Privacy Policy). If you lose or reset your device, the copy is lost.

PELAV does not issue, verify, renew, authenticate or replace any licence; your original licence and the licensing authority's requirements still apply.

10. Free access

This version of the App is free. It has no Premium tier and no Premium-only features: every feature it offers, including Solunar Activity and best-fishing-window suggestions, is available to every account. It does not sell subscriptions or offer free trials, and there is no purchase or restore-purchase option in it. The Length-to-Weight calculator is not available in this version of the App.

If we introduce paid features in a later version, we will first publish updated Terms and ask you to accept them, and we will show the price, billing period and how to cancel before you are asked to pay.

11. Content and intellectual property

You own the content you submit. You give PELAV a limited licence to store, process and display it back to you to operate the App.

PELAV, its design, features, species knowledge base and software belong to Continuum Dataguard Technologies or its licensors. Third-party data shown in the App remains subject to its owners' rights and licences, as described in the Data Sources and Attribution notice.

12. Prohibited use

You must not use PELAV unlawfully; try to access another person's account or data; interfere with or overload the App or its backend; scrape or redistribute PELAV's or its providers' data; or reverse-engineer the App except as the law allows.

13. Availability and changes to the service

We may change, suspend or stop any part of PELAV, including features that depend on third-party providers. We will try to give reasonable notice of material changes where practical.

14. Third-party services

PELAV relies on independent providers, including Supabase (accounts, database, backend), Resend (account emails), Open-Meteo (weather and sea data), WorldTides (tide predictions), OpenStreetMap (maps) and Firebase Crashlytics (crash reports). We do not control them, and each has its own terms. To the extent the law allows, we are not responsible for their accuracy, availability or performance.

15. Suspension and termination

We may suspend or close your account if you breach these Terms or if we reasonably believe your use puts PELAV, other users or others at risk. You may stop using PELAV at any time.

16. Account deletion

You can delete your account at any time in the App (Profile > Delete Account), including from the screen that asks you to accept updated Terms, or by emailing us from your account's email address if you cannot use the App. What is deleted and what is kept is set out in the Privacy Policy and on our account deletion page. Deletion cannot be undone.

17. Privacy

The Privacy Policy explains how we handle personal information and forms part of your agreement with us. If these Terms and the Privacy Policy conflict about personal information, the Privacy Policy applies.

18. Limitation of liability

This section limits our liability to you. PELAV is free and gives general information only (section 7).

To the extent the law allows, we are not liable for loss or damage that arises from:

We are also not liable for indirect or consequential loss, such as loss of profit or of opportunity.

This section does not limit or exclude:

19. Consumer rights

Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded. If these Terms conflict with such a right, your statutory right applies.

20. Indemnity

This section asks you to compensate us in limited cases.

If someone else makes a claim against Continuum Dataguard Technologies because you breached these Terms or used the App unlawfully, you agree to compensate (indemnify) us for the reasonable loss and costs that claim causes us, including reasonable legal costs.

This does not apply to the extent that the loss was caused by our own negligence, wilful misconduct or breach of these Terms. It does not limit any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be excluded.

21. Changes to these Terms

When we change these Terms we publish a new version with a new version number and date, and the App asks you to read and accept it before you continue. We do not treat continued use as acceptance.

22. Governing law

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have non-exclusive jurisdiction over disputes arising from them.
